The mediator is in charge of the process. The parties are in charge of the outcome. It follows, therefore, that a mediator’s expertise is about the process and not the content. That is the lawyer’s role and the client’s responsibility to fully inform himself or herself about the content.

Consequently, in order for the self-determination process to work, mediators don’t

  • offer advice or opinions
  • predict outcomes
  • make recommendations as to the outcome.
