Summary of Proceedings
Harrison Pensa LLP has issued a Statement of Claim on July 30, 2019 on behalf of a proposed class of all persons and entities in Canada who purchased HDD Suspension Assemblies, or products which contained HDD Suspension Assemblies from as early as May 1, 2008, up to the present (the “Class Period”).
HDD Suspension Assemblies are incorporated into hard disk drives, which are found in electronic devices such as computers, gaming consoles, video recorders, and stand-alone storage devices.
The proposed class action alleges that the Defendants participated in illegal and secretive meetings and conspired and/ or agreed with each other to fix, maintain, increase and control the price for supply of HDD Suspension Assemblies and/ or enhance unreasonably the prices of HDD Suspension Assemblies and to lessen unduly competition in the sale of HDD Suspension Assemblies in Canada.
The action seeks to recover the anticompetitive pricing overcharge that class members paid for HDD Suspension Assemblies during the Class Period.
Status of Proceedings
This matter has been filed in London, Ontario. The Certification Motion has not yet been scheduled. Further information will be posted as this matter proceeds.
