Summary of the Proceedings
On December 12th, 2008, Harrison Pensa LLP issued a Statement of Claim on behalf of any person or entity in Canada who purchased a computer labeled “Vista Capable” in the retail context between April 1, 2006 and January 30, 2007. It is alleged that during this time the Defendants directed the application of a “Microsoft Vista Capable” label to tens of thousands of computers sold in Canada which were not in fact capable of running the Microsoft Vista operating system. As a result, it is alleged that the proposed class members are entitled to damages and statutory and equitable remedies.
Status of the Proceedings
This matter has been filed in London, Ontario. The Certification Motion has not yet been scheduled. Further information will be posted as this matter proceeds.
