DRAM (Dynamic Random Access Memory) manufacturers were alleged to have fixed the price of DRAM between April 1, 1999 and June 30, 2002. It is alleged that all purchasers of DRAM during the class period were overcharged as a result of the anti-competitive conduct of the Defendants.

Class Counsel – comprised of Harrison Pensa and Sutts, Strosberg in Ontario; Camp, Fiorante, Matthews, Mogerman in British Columbia; and Belleau Lapointe in Quebec – reached settlements totaling $80 million for the benefit of all Canadians who purchased DRAM from one of the Defendants between April 1, 1999 and June 30, 2002.

The deadline for making claims under the settlement administration process was on June 23, 2015. Since then, Class Counsel and the administrator of the settlements (“Claims Administrator”) have been working hard to process the more than 1 million claims received.

$20 Claims

Over 880,000 claims for $20 were approved by the Court in November 2015. These cheques were mailed out to class members with approved claims in December 2015.

Please cash your cheque now, if you have not already done so.

The Claims Administrator has also sent emails to some people whose claims were not approved, or who needed to send more information. If you did not send in more information when asked, or if you received an email saying that your claim had not been approved, you will not be receiving any money.

All Other Claims (Some $20 Claims and Standard Claims)

All other claimants were sent a decision notice at the end of 2015, which either approved the claim or rejected it.

The payment of these claims has not yet been approved by the Courts. It is anticipated that Court approval will be granted in early May 2016. If this happens, these cheques will be mailed shortly thereafter.
