Summary of the Proceedings

On February 15th, 2008, Harrison Pensa LLP issued a Fresh as Amended Statement of Claim against Canadian National Railway on behalf of all persons who purchased rail freight shipping services from Canadian National Railway (“CN”) for shipments within, to or from locations in Canada and were made subject to fuel surcharge tariffs, CN 7400 and 7401. The Statement of Claim alleges that fuel surcharge tariffs CN 7400 and CN 7401 are unlawful as they result in CN recovering more than their incremental increase in fuel costs. As a result, it is alleged that proposed class members are entitled to damages and statutory and equitable remedies.

Status of the Proceedings

This matter has been filed in London, Ontario. The Certification Motion has not yet been scheduled. Further information will be posted as this matter proceeds.
