Summary of the Proceedings
On June 9th, 2011, Harrison Pensa LLP issued a Statement of Claim on behalf of Canadians who purchased organic roofing shingles manufactured by Building Products of Canada Corp. The action alleges breaches of Canadian consumer protection legislation, negligence, and breach of warranty. The action claims for all losses and damages related to the organic roofing shingles including the costs associated with removing and replacing the shingles and damages related to diminution in value and/or overpayment for the shingles.
Status of the Proceedings
On January 19, 2012, a settlement agreement was reached with the Defendant BP.
On March 28, 2012, the action was certified on consent for settlement purposes and the Notices were approved.
Settlement approval has now been granted by the Courts in Ontario, Quebec and in the US. The effective date of this settlement is January 21, 2013.
