David S. Swift

David is a litigation partner and Practice Group Leader of Harrison Pensa’s Bankruptcy, Insolvency and Restructuring Law Group. His practice focuses on secured enforcement and other insolvency matters including mortgage enforcement, as well as on construction liens and other commercial litigation.

A wide range of commercial clients rely upon David’s extensive litigation knowledge and experience, which includes proceedings in the Ontario Superior Court of Justice and the Ontario Court of Appeal. Credit unions, banks, and other lenders seek out David’s assistance in collecting loans from insolvent or underfunded clients. Suppliers and general contractors call on David to help resolve numerous construction-related problems, while business owners turn to him when facing commercial litigation challenges such as non-payment and breach of contract allegations.

In addition to his role as Insolvency Group Leader, David is also a member of Harrison Pensa’s Partnership Board and is a Business Development Mentor within the firm. He has prepared several papers and has been a frequent presenter to both clients and professional associations (including the Ontario Bar Association) on construction lien and insolvency topics. During his undergraduate days at the University of Western Ontario (1989-90 to 1992-93), David was a member of the Western Mustangs football team.

When he is not serving clients, David is highly active within the community, serving as a Director of Make a Wish Southwestern Ontario and as a member of the London Home Builders Association, the Middlesex Law Association, and the Canadian Bar Association. While his top priority remains his family, he also enjoys running, having completed several marathons.
