On January 8, 2004, Harrison Pensa LLP issued a Statement of Claim against United Parcel Service (UPS) on behalf of a group of retirees, all of whom are members of the UPS salaried employees post-retirement benefits program. The matter relates to the unilateral reduction of post-retirement benefits by UPS.

Life insurance coverage, dental benefits coverage and extended health coverage such as drug benefits and optical benefits were either reduced or eliminated in some form by UPS effective July 1, 2003. The proposed representative plaintiffs are former senior management and human resources employees of the Livingston Group of Companies, a company which was acquired by UPS in October of 2000.

Status of the Proceedings

This matter has been settled. The Honourable Justice Maurice Cullity certified this matter on November 16th, 2006 conditional on settlement approval. Justice Cullity granted settlement approval on February 13, 2007. A copy of the settlement approval Decision is posted below. Notices regarding settlement approval and copies of the new retiree benefit booklet were mailed to class members in February 2007.
