Summary of the Proceedings
On July 31, 2009 a Statement of Claim was issued against the following Defendants:
- Air Canada
- British Airways
- Delta Air Lines, Inc.
- Deutsche Lufthansa A.G.
- Koninklijke Luchtvaart Maatschappij N.V. (KLM)
- Societé Air France
- UAL Corporation
on behalf of a proposed class of all persons in Canada who during the class period paid air passenger surcharges for passenger services to or from Canada, including flights connecting at US airports, and trans-Atlantic destinations operated by the defendants.
The plaintiffs allege that the defendants engaged in a conspiracy to enhance unreasonably the price of passenger services by the adoption and adjustment of surcharges on top of the cost of base fares for flights to and from Canada and various trans-Atlantic destinations operated by the defendants.
The plaintiffs seek general damages for violations of the Competition Act and wrongful conduct at common law, and punitive and exemplary damages.
Harrison Pensa LLP is working in concert with Sutts, Strosberg LLP in the prosecution of this matter.
