On January 25, 2008 a Statement of Claim was issued against Korean Air Lines Co., Ltd. (“Korean Air”) on behalf of a proposed class of air passengers travelling from Canada to Asia between January 1, 2000 to and including July 31, 2006. The action alleges that Korean Air engaged in anti-competitive conduct in the implementation of fuel surcharges and in the setting of prices for passenger fares. As a result, it is claimed that the class members were overcharged on their passenger fares during the class period.
Harrison Pensa LLP will be working in concert with Sutts, Strosberg LLP and Siskinds LLP in the prosecution of this matter.
On August 23, 2007, Korean Air pleaded guilty to anti-trust conspiracy charges in the United States. Specifically, Korean Air admitted that it colluded with its rivals in respect of fuel surcharges and base rates on passenger fares from airports in the United States to locations in Asia.
